Terms of Service

1. Agreement to Terms

By accessing or using Amanda AI (“the Service”), operated by Amanda AI, LLC, a Florida Limited Liability Company, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is available at amandaaiplanner.com and app.amandaaiplanner.com, and through SMS text messaging.

2. Description of Service

Amanda AI provides group trip coordination and planning assistance. The Service allows trip organizers to create trips, invite participants via a shareable link, collect preferences through private SMS surveys, and receive AI-generated trip recommendations. The Service includes:

  • Trip creation and management via the web-based admin dashboard
  • Participant opt-in and preference collection via SMS text messaging
  • AI-powered trip recommendation generation using third-party AI services (OpenAI and Anthropic Claude)
  • Live dashboard tracking of participant responses

3. User Accounts and Eligibility

You must be at least 18 years of age to use the Service as a trip organizer. By creating an account, you represent that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. SMS Messaging Terms

By opting in to receive SMS messages from Amanda AI, you consent to receive text messages related to trip planning, including survey questions, trip updates, and recommendations.

  • Message Frequency: Message frequency varies depending on the specific trip and group activity.
  • Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. Contact your wireless provider for details about your text plan or data plan.
  • Opt-Out: You can cancel the SMS service at any time by texting “STOP” to the number we text you from. After sending “STOP,” we will send a confirmation message and you will no longer receive SMS messages from us. To rejoin, sign up again as you did the first time, or reply “START” to resume receiving messages.
  • Help: If you are experiencing issues with the messaging program, reply with the keyword “HELP” for assistance, or contact your trip organizer directly.
  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

5. Pricing and Payment

  • Per Trip: $25 per trip, pay as you go.
  • Annual Plan: $100 per year for unlimited trips.
  • First Trip: Your first trip is free. No credit card required to get started.

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your selected payment method. Prices are subject to change with 30 days prior notice.

6. AI-Generated Recommendations

Amanda AI uses artificial intelligence (including OpenAI and Anthropic Claude) to generate trip recommendations based on participant responses. These recommendations are provided for informational purposes only. Amanda AI does not guarantee the accuracy, availability, or suitability of any recommendation.

Amanda AI is a decision-support tool, not a travel agency. We do not book hotels, flights, transportation, or any travel services. The responsibility for booking and confirming travel arrangements rests entirely with the trip organizer and participants.

7. Travel Agent Referrals

Amanda AI may offer the option to connect with third-party travel agents for booking assistance. These travel agents are independent professionals and are not employees, contractors, or agents of Amanda AI, LLC. Amanda AI is not responsible for the services, pricing, quality, or actions of any referred travel agent. Any engagement with a travel agent is a separate agreement between you and that agent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMANDA AI, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Amanda AI’s total liability for any claim arising from the Service shall not exceed the amount you paid to Amanda AI in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AMANDA AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the property of Amanda AI, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent.

11. User Conduct

You agree not to use the Service to:

  • Send spam, unsolicited messages, or harassing content
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any fraudulent or illegal purpose

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Collier County, Florida.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised “Last Updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
